The situation grandchildren are exposed to varies greatly. Some are in a positive stable environment, and grandparents are simply denied access or may be allowed very limited contact with their grandchildren. The other end of the spectrum is a situation that needs to be addressed as soon as possible. If you can prove your grandchildren are being subjected to an abusive and neglectful environment, the Illinois judicial system will act quickly and forcefully on your behalf. Don’t think for one second that as grandparents your rights will be restricted or limited. If your grandchildren are in an abusive or neglected environment you may file a petition for a IL child protective proceeding. If abuse, neglect, or imminent danger exist, child protective services may enforce an emergency removal of the children and place them into protective custody. A child protective proceeding is typically followed by a number of court hearings. A fact-finding court hearing is set to determine if the allegations are true. A dis-positional hearing is set to decide what should be done if the child has been neglected or abused. Finally, a permanency hearing is set to determine and finalize the permanent placement and security of the children.

It’s important to recognize, the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) was established to ensure that any Broken Families, Marriages, Relationships, Children, Teenagers, and Parents Need Help Nowchild custody litigation occurs in the child’s “home state”. The “home state” is defined as the last state where a child has lived for 6 consecutive months with a parent. My grandson is 16 months old. Because of a disagreement with his mother, over bringing him to a Fourth of July party, his mother refuses to allow him or any of my side of the family to see him. We can’t even see pictures of him. It is killing me that I have missed out on over a year of his life. He is my only grandson by blood. My husband has grandchildren that we see and babysit all the time. The youngest is four. They can tell you that we are excellent grandparents, and would never consider not letting us see them. Even though we have had disagreements with them in the past. Can anyone help me or even relate to my situation?

My stepdaughter is pregnant and going to give the baby up for adoption. She wanted her mother and I to adopt the baby, but her boyfriend doesn’t want us to have it and wants it to go to the state. He has threatened her to the point that she is thinking about doing this. Is there anyway we can step in, and adopt the baby anyway? Concerned grandparent.

Due to a disagreement with my son and his sons mother, she won’t allow me or my son to see my grandson. We were not allowed to acknowledge him on his fifth birthday; which was August 3rd. I have been apart of his life since his birth. I miss him so much. I fear that she’s feeding him negative thoughts about us. I don’t want him to feel like we have forgotten about him or just threw him away.
