NE grandparents can also file for full custody, guardianship, or adoption, to raise their grand-kids, through a NE family law custody court judicial process. The proper legal advice, guidance, and strategies are key to ensure a successful outcome to any predicament regarding your grandchildren. Fortunately, studies have shown that the “Best Interests” for your grandchildren is that they have an active relationship with their grandparents. Grandfathers and grandmothers can often provide a healthier and more stable environment than the children’s biological parents. As a result, Nebraska’s “Best Interest of the Child” guideline fully supports a grandparents’ rights for visitation and custody. The legal extent to which you can visit, provide, and support your grandchildren will need to be determined and approved through a NE family law court hearing litigation process.

Typically, most if not all of these circumstances Grandparents Visitation and Custody Rights - Grandchildren Need Grandparents Help Protecting Them from Abuse and Neglectare completely out of their control. This unhealthy environment is a damaging situation for children’s emotional and physical well-being. Children often don’t have a voice to be heard, and it is our responsibility as grandparents to be that voice. A voice that defends, supports, protects, and cares for all grandchildren that so desperately need our help.

The Nebraska Judicial Legal System Recognizes the Importance of Grandparents’ Rights Regarding Visitation and Custody of Grandchildren; and Fully Understands That Abuse and Neglect are Prevalent in NE Families.

NE family law fully acknowledges the ability for grandparents to provide a positive and stable environment. An environment, which is able to provide leadership, and a parenting platform so many children desperately need. Grandchildren even spending limited time with their grandparents can help provide the much-needed comfort and security that children require on a regular basis.

The situation grandchildren are exposed to varies greatly. Some are in a positive stable environment, and grandparents are simply denied access or may be allowed very limited contact with their grandchildren. The other end of the spectrum is a situation that needs to be addressed as soon as possible. If you can prove your grandchildren are being subjected to an abusive and neglectful environment, the Nebraska judicial system will act quickly and forcefully on your behalf. Don’t think for one second that as grandparents your rights will be restricted or limited. Remember, the “Best Interest of the Children” is a standard that is fully recognized and supported in the state of Nebraska.

If your grandchildren are in an abusive or neglected environment you may file a petition for a NE child protective proceeding. If abuse, neglect, or imminent danger exist, child protective services may enforce an emergency removal of the children and place them into protective custody. A child protective proceeding is typically followed by a number of court hearings. A fact-finding court hearing is set to determine if the allegations are true. A dis-positional hearing is set to decide what should be done if the child has been neglected or abused. Finally, a permanency hearing is set to determine and finalize the permanent placement and security of the children.

It’s important to recognize, the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) was established to ensure that any Broken Families, Marriages, Relationships, Children, Teenagers, and Parents Need Help Nowchild custody litigation occurs in the child’s “home state”. The “home state” is defined as the last state where a child has lived for 6 consecutive months with a parent. This act was adopted to discourage parents from moving out-of-state in an attempt to manipulate the judicial system for whatever reason. Parental attempted kidnapping by moving children to another state or jurisdiction was one of the main reasons the UCCJEA was adopted.

Out-of-state (TX) grandparents wanting visitation rights with NE 6 yr old female grandchild. The parent with custody has in times past given permission for a 2 week visit only to cut it short to 3-7 days. The parent cuts the visit short stating the reason is we allowed her to stay at the noncustodial parent’s home for one night and a boy was there which subjected the grandchild to possible rape. The boy is her 11 yr old stepbrother, whom has not made; to anyone’s knowledge, any untrustworthy actions towards her or any of his other many female cousins. We, the grandparents have a desire to be more involved than 1 cut short visit per year.

We’re Grandparents caring for a 16 year old Grandson.
    The mother moved to Florida.
The father has drug & alcohol problems, that left the Grandson homeless.

We are seeking child support from the parents.
We don’t want to file for custody or guardianship.

I am not allowed to see my grandson who was born in October. I believe my daughter in law has told my son that if he has any contact with this side of the family, she will leave and take him with with her. My heart is torn. So is other family members. We live in the same town. I have nine other grandchildren and yet I can’t get past this. So torn.

I (paternal) grandmother raised my grandson since born 2009. Emergency temporary expired, and biological mom is a meth user and the biological dad is incarcerated. Bio-mom gets put on probation for 2 years while the entire time lying about her address because she had no address and was using under the radar and has not stopped since. The entire time dragging my Grandson(Nathaniel) and leaving him where ever and anyplace, CPS finally caught up with her. Nathaniel is staying now with estranged member and non-members of his blood relation. Current guardian was conveniently “hand-picked” per bio-mom as she was cornered by CPS. Bio-mom and current “guardian” conspired to hurry up and place Nathaniel in “current guardian’s” household with total strangers, current “guardian” HATES my son whom is incarcerated. Current “guardian’s” MOTHER is out on parole for attempted murder. Current “guardian” is allowing bio-mom to have UNSUPERVISED visits. Bio-mom’s boyfriend has CHILD PORNOGRAPHY ON HIS PERSONAL ELECTRONIC DEVISES. Current “guardian” at least is biased and doesn’t give 2 shits about Nathaniel, she is biased and ONLY cares about her conveniently “hand-picked” cousin whom is LYING to the judge and everybody that will listen to her. Where was the current “guardian” during those 2 years bio-mom was using drugs and dragging Nathaniel and abandoning Nathaniel the entire time??? The ONLY reason “all of the sudden” has stepped up for “guardian” is because CPS IOWA cornered HOMELESS DRUGGED OUT BIO-“MOM”. I have all documentation proving all of the aforementioned proceedings.

My husband and I helped raise our 8 year old grandson. My husband died 4 months ago and my daughter extremely mad at me and now refuses to let me see my grandson. He went on vacations with us, and was here at our home as much as with mom. I need help and am unsure where to turn. Every year we bought school clothes and supplies. Now that his grandpa died he is scared he is going to lose his grandma.
